Terms of Service

1. Eligibility

3. Subscription Services and Billing

Certain Services may require a paid subscription or a valid payment method on file. By subscribing or providing payment information, you authorize my859 and its payment providers to charge your selected payment method for subscription fees, applicable taxes, recurring renewals unless canceled, and usage-based charges where applicable.

Subscriptions may automatically renew unless canceled before the renewal date.

We reserve the right to modify pricing, change subscription plans, introduce new paid features, or adjust feature availability between plan tiers. Reasonable notice will be provided for material pricing changes where required by law.

4. Free Trials and Promotional Access

my859 may offer free trials, beta access, promotional plans, or limited-use subscriptions. Unless canceled before the applicable trial or promotional period ends, your subscription may automatically convert into a paid subscription and your payment method may be charged. We reserve the right to modify or terminate promotional offers at any time.

5. Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Unless otherwise stated:

• Subscription fees are non-refundable
• Partial billing periods are not prorated
• Cancellation prevents future renewals but does not retroactively refund prior charges

Nothing in this section limits rights that cannot legally be waived under applicable law.

6. Acceptable Use

You agree not to:

• Violate laws or regulations
• Infringe intellectual property rights
• Attempt unauthorized access to systems or accounts
• Interfere with platform functionality or security
• Upload malicious code or harmful content
• Use the Services to harass, abuse, spam, or impersonate others
• Reverse engineer or attempt to extract source code except where legally permitted
• Use the Services to generate unlawful, fraudulent, defamatory, or harmful content
• Circumvent subscription or usage limitations

We reserve the right to suspend or terminate accounts violating these Terms.

7. AI-Generated Content Disclaimer

my859 uses artificial intelligence to generate summaries, recommendations, drafts, analyses, workflows, and related outputs. AI-generated outputs may be inaccurate, incomplete, contain errors, or produce unintended results.

You acknowledge and agree that:

• AI outputs are provided for informational and productivity purposes only
• You are solely responsible for reviewing and validating outputs before relying on them
• my859 is not responsible for decisions made based on AI-generated content

We attempt to automatically mask personal, sensitive, and financial information that may appear in connected data sources before it is included in AI-generated outputs. This is a best-effort technical safeguard and is not guaranteed to catch every instance. You remain responsible for reviewing outputs before sharing or acting on them.

The Services are not intended to replace professional legal, medical, accounting, compliance, financial, or other regulated advice.

8. User Content and Data Ownership

You retain ownership of your content, prompts, files, communications, and connected platform data ("User Content"). By using the Services, you grant my859 a limited, non-exclusive license to host, process, analyze, transmit, and display User Content solely for the purpose of operating and improving the Services you request. We do not claim ownership of your User Content.

9. AI Model Training Restrictions

Your personal content, prompts, emails, messages, files, and connected service data are NOT used to train public or shared AI models. my859 does not sell or contribute your identifiable content into generalized AI training datasets.

10. Third-Party Integrations

The Services may integrate with third-party platforms and providers. You acknowledge that:

• Third-party services operate independently from my859
• We are not responsible for third-party platforms or outages
• Your use of third-party services is subject to their own terms and policies

You may revoke integration permissions at any time through the applicable provider settings.

11. Service Availability

We strive to provide reliable Services but do not guarantee uninterrupted availability. The Services may occasionally experience downtime, delays, maintenance interruptions, technical issues, or AI processing limitations. We reserve the right to modify, suspend, or discontinue portions of the Services at any time.

12. Intellectual Property

The Services, including software, branding, interfaces, designs, workflows, logos, and platform functionality, are owned by or licensed to my859 and protected by intellectual property laws. Except as expressly permitted, you may not copy, distribute, modify, resell, create derivative works from, or exploit any portion of the Services.

13. Feedback

If you provide suggestions, ideas, or feedback regarding the Services, you grant my859 the right to use that feedback without restriction or compensation.

14. Privacy

Your use of the Services is also governed by our Privacy Policy. By using the Services, you acknowledge and agree to the practices described in the Privacy Policy.

15. Termination

We may suspend or terminate access to the Services if:

• You violate these Terms
• Your use creates security or legal risks
• Required by law
• Necessary to protect the platform or users

You may stop using the Services at any time. Sections intended to survive termination will remain in effect after termination.

16. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, my859 DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AND AVAILABILITY. We do not guarantee that the Services will be uninterrupted or error-free, that AI outputs will always be accurate, or that the Services will meet every expectation or requirement.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, my859, JTOG CONSULTING, LLC, AND THEIR AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND PARTNERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR REPUTATIONAL HARM ARISING FROM OR RELATED TO USE OF THE SERVICES, INABILITY TO USE THE SERVICES, AI-GENERATED OUTPUTS, THIRD-PARTY SERVICES, OR SECURITY INCIDENTS.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO my859 DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

18. Indemnification

You agree to defend, indemnify, and hold harmless my859, JTOG Consulting, LLC, and their affiliates from claims, liabilities, damages, losses, and expenses arising from your use of the Services, your User Content, your violation of these Terms, your violation of applicable law, or your infringement of third-party rights.

19. Governing Law

These Terms shall be governed by and construed under the laws of the State of Florida, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Florida.

20. Changes to These Terms

We may update these Terms periodically. Updated versions will be posted with a revised effective date. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
